In this video I summarise the decision of the Supreme Court in Afzal, R (on the application of) v Secretary of State for the Home Department [2023] UKSC 46 (28 November 2023) www.bailii.org/uk/cases/UKSC/2023/46.html which concerns 10 years lawful residence, disregarded overstaying, section 3C leave and rule 39E.
From Supreme Court press summary: ‘Having regard in particular to the natural meaning of “disregarded”, the Court holds that this period of overstaying cannot be added to the periods of lawful residence either side of it to make up a total of 10 years lawful residence’
